Scena Terms of Service

These Terms of Service ("Terms") are an agreement between you and Scena Labs LLC, a Washington limited liability company ("Scena", "we", "us"). They cover your use of the Scena mobile app for Android and iOS (the "App") and our website, getscena.com (the "Site"). Together we call these the "Services". By signing in to the App, or by otherwise using the Services, you agree to these Terms. If you don't agree, don't use the Services.

Our Privacy Policy explains how we handle personal information. You acknowledge it when you sign in. It is not part of this agreement.

1. Who can use Scena

• You must be at least 13 years old. If you are under the age of majority where you live, you may use Scena only with the involvement of a parent or guardian, who agrees to these Terms on your behalf.
• You must be able to form a binding contract and not be barred from using the Services under applicable law.
• You sign in with a Google account. You are responsible for activity under your Scena account and for keeping your device and Google account secure.

2. What Scena does

Scena helps you turn your photos and videos into short, music-timed reels. You can pick media, choose a look and a sound, edit, export the reel to your device, and share or publish it. Some features are optional and send content off your device when you use them. These include AI editing (Director and Smart edit), "Bring it to life", suggestions from your camera roll, and publishing to Instagram. The Privacy Policy describes each one.

We are improving Scena all the time. Features may change, be limited, or be removed, and some may be labelled beta or experimental. Beta features may not work as expected.

3. Your content

• You own your content. "Your content" means the photos, videos, text and other material you use in Scena, and the reels you make.
• The licence you give us. You give Scena a non-exclusive, worldwide, royalty-free licence to host, store, process, copy, adapt and transmit your content. This licence lasts only as long as needed to provide the Services to you: for example, to generate and store your reel's edit data, to run the features you choose, and to publish to services you ask us to publish to. We don't use your photos or videos for advertising, and we don't sell them.
• Your responsibility. You confirm that you have the rights you need to the content you use, including permission from the people who appear in it where the law requires it. You confirm that your use of it in Scena doesn't break the law or anyone else's rights.
• Deleting. You can delete reels in the App and delete your account (Settings → your name under Account → Delete account). What we delete, and when, is described in the Privacy Policy.

4. Music and third-party content

• Music, sound effects, fonts, looks, stock clips and other material that Scena provides ("Scena content") are licensed to you only for making reels in Scena and sharing them as the App allows. Some tracks come with restrictions from their rights holders. For example, a track may be usable only for certain kinds of posting, or may not be available in every country or on every platform. When the App shows a restriction, you agree to follow it.
• You may not extract, download separately, resell or redistribute Scena content outside of the reels you make, except as the App expressly allows.
• When you publish to Instagram or another service, that service's own terms and community rules apply. Scena is not responsible for those services. They can decline, remove or limit content under their own rules.

5. AI features

• Some features use machine-learning models, including Google's Gemini and Veo models, to suggest titles, edits, picks or animations. Their output can be unexpected, inaccurate or unsuitable. Review what they produce before you share it.
• You are responsible for the reels you choose to export, share or publish, including any AI-generated parts.
• Don't use AI features to create content that is unlawful, deceptive about real people, sexual content involving minors, or otherwise prohibited by section 6.

6. Acceptable use

When you use the Services, you agree not to:

• break the law, or infringe anyone's intellectual property, privacy or publicity rights;
• upload or create content that is sexual content involving minors, non-consensual intimate imagery, harassment, hate, threats, or content that promotes violence or self-harm;
• impersonate others, or mislead people about who made or appears in a reel;
• try to access the Services or other users' data without permission, or interfere with, overload, scrape or reverse-engineer them, except as the law allows despite this restriction;
• get around usage limits, integrity checks or security measures;
• use the Services to build a competing product, or to train machine-learning models on Scena content.

We may remove content, limit features, or suspend or end accounts that break these rules.

7. Scena's rights

The Services, including the App, the Site, Scena content, our software, designs, templates and trademarks, belong to Scena and its licensors. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own use. If you send us feedback or suggestions, we may use them without any obligation to you.

8. App stores

If you got the App from Apple's App Store or Google Play, these Terms are between you and Scena, not Apple or Google. Apple and Google are not responsible for the App or for supporting it. If you use the App on an Apple device, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App must also follow the applicable store's usage rules.

9. Scena Crew (subscriptions, free reels and codes)

Scena is free to start. Scena Crew is the paid plan. It unlocks features that the App marks with a CREW tag, and it removes the Scena watermark from your reels. The App shows what Scena Crew includes before you buy.

Subscriptions.

• Scena Crew is an auto-renewing subscription, monthly or yearly. You buy it through the App Store or Google Play, and the payment is charged to your store account.
• It renews automatically for the same period unless you cancel at least 24 hours before the current period ends. Your store may charge your account for the renewal in the 24 hours before the period ends.
• You cancel in your store's subscription settings. Deleting the App or your Scena account does not cancel your subscription. Cancel first, then delete.
• Apple or Google handles refunds under their own policies. We can't issue refunds for store purchases.
• Prices are shown in the store and may vary by region.
• If the price of a subscription goes up, Apple or Google tells you in advance and may ask you to agree before it renews at the new price.
• Where a free trial is offered, it turns into a paid subscription when it ends unless you cancel before then. If you buy a subscription during a trial, any unused trial time is forfeited.

Your first 3 reels on us. When you create a new account, your first 3 reels are on us. They come with Scena Crew features and no watermark. You must use them within a set window after you sign up. The App shows how many you have left and when the window ends. A reel uses up one of the 3 the first time you export or post it. A reel you haven't posted by the end of the window becomes an ordinary free reel.

"Bring it to life" clips. Scena Crew includes a monthly allowance of "Bring it to life" clips. The App shows your allowance. Unused clips do not roll over to the next month.

Codes.

• A code is a one-time offer code, redeemed through the App Store or Google Play. It gives you Scena Crew for the period stated with the code (currently 3 months).
• A code does not renew and you are never charged for it. When the period ends, Scena Crew ends unless you subscribe.
• Each code works once, and only in the store that issued it. A code has no cash value and can't be exchanged, sold or transferred. A code may expire. The expiry date is shown when you get the code.
• The period you get attaches to the Scena account that is signed in when the App sees your redemption. If you redeem another code while you still have time left, the new period starts when the current one ends.
• We may void a code that was obtained improperly, for example one that was bought, sold or generated without our permission, and we may end the Scena Crew access it gave.

10. Ending your use

You can stop using Scena at any time and delete your account in the App. We may suspend or end your access if you break these Terms, if we must for legal reasons, or if we stop offering the Services. Where it's reasonable, we'll tell you first. Sections 3 (the parts about your responsibility), 4, 7 and 11–14 continue after your use ends.

11. Disclaimers

The Services are provided "as is" and "as available". To the fullest extent the law allows, Scena disclaims all warranties, express or implied. These include warranties of merchantability, fitness for a particular purpose, and non-infringement. Scena also does not promise that the Services will be uninterrupted, error-free or secure, or that your content won't be lost. Keep your own copies of anything that matters to you. Your original photos and videos stay in your device's library. Scena does not modify or delete them.

12. Limitation of liability

To the fullest extent the law allows, Scena and its affiliates, officers, employees and licensors will not be liable for any indirect, incidental, special, consequential or punitive damages. They will also not be liable for any loss of data, content, profits or goodwill arising from or related to the Services. Scena's total liability for any claim related to the Services is limited to the greater of (a) the amount you paid Scena for the Services in the 12 months before the claim and (b) USD 50.

Some places don't allow these exclusions or limits. Where that's the case, they apply only to the extent the law allows. Nothing in these Terms limits liability that can't be limited by law, or your rights as a consumer under mandatory law where you live.

13. Indemnity

To the extent the law allows, you agree to defend and indemnify Scena against claims, losses and costs, including reasonable legal fees, that arise from your content or from your breach of these Terms.

14. Disputes and governing law

If you have a problem with Scena, please contact us first at support@getscena.com, so we can try to resolve it informally. These Terms are governed by the laws of the State of Washington, USA, and applicable US federal law, without regard to conflict-of-law rules. If you live in the European Economic Area, the UK or another place whose mandatory consumer protection law applies to you, you keep those protections and may bring claims in your local courts.

15. Changes to these Terms

We may update these Terms. If a change is material, we'll tell you in the App before it takes effect, and we may ask you to accept the updated Terms to keep using Scena. The current version and its date are always at https://getscena.com/terms. If you keep using the Services after an update takes effect, you accept the updated Terms.

16. General

These Terms, together with any terms shown in the App for a specific feature, are the whole agreement between you and Scena about the Services. If any part is unenforceable, the rest stays in effect. If we don't enforce a provision, that doesn't mean we've waived it. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets.
